Terms & Conditions Of Service
Between just Little Bird (Designer), + the Client (You)
As our client, you have the power + ability to enter into this contract on behalf of your company or organization. You agree to provide just Little Bird with everything that is needed to complete the project including text, images + other information as + when designer requires it, + in the acceptable format that designer asks for. You agree to review designer's work, provide feedback + sign-off approval in a timely manner. Deadlines work both ways, so you will be bound by any dates that are set together with designer. You also agree to stick to the terms below.
Design
just Little Bird will create designs for the look, feel, layout + functionality of your project. Most jobs include one main design plus the opportunity for you to make up to 3 rounds of alterations. If you are not happy with the designs at this stage, you will pay designer in full for all of the work that has been produced until that point + you may either cancel this contract or continue to commission designer to make further design revisions at the daily rate set out in the original estimate. Designer services extend only to what is outlined in the scope of work +/or quote, or agreed upon by both parties in writing.
Text content
just Little Bird are not responsible for writing or inputting any text copy unless previously agreed. You are ultimately responsible for + ensure all text supplied is complete, thoroughly checked + accurate, although utmost care will be taken by designer to check + amend. Any additional time needed for copy writing or proof reading will be charged at the usual hourly rate.
Photos + imagery
You will supply the designer photos either in digital or printed format. If digital, they will be at the highest resolution, + appropriate for use. If you need a guide to photo resolution + quality, please email just Little Bird. Designer can work with you to choose imagery from stock libraries if needed. This time for searching will be charged at the usual hourly rate.
Changes + alts
All estimate/quotation prices are based on the number of hours that the designer estimates will take to accomplish everything that you have supplied + want to achieve including 3 rounds of edits to initial design prior to work being finalised +/or prepared for print. On your request to apply additional edits to any work, that time will be charged out by the hour. All changes + alterations must be emailed to just Little Bird, so to keep track of all requests made.
Liability
Final artwork will not be sent to print, nor will websites be made live until you have approved to do so whereby accepting responsibility that the information contained within the artwork/website is correct. Designer will not be held responsible for any amendments or reprints required as a result of errors noticed after final client approvals, unless designer accepts in writing sole responsibility for creating an error that client did not supply or that the client could not be reasonably expected to notice. No liability will be taken by the designer for any loss of earnings or otherwise financial +/or image loss of the company throughout which time the website +/or artwork is being created.
Designer is not responsible for fixing or altering any mistakes the client physically makes themselves to a website +/or artwork unless agreed upon in writing within the scope of work. In the event that a time frame cannot be achieved by the designer - for any reason other than the designer reneges on the contract, the designer accepts no responsibility for any direct or indirect consequences such as (but not limited to); loss of earnings or the inability for the client to meet third party contractual obligations. Designer also does not accept liability for any consequences resulting from any serious or debilitating health issues, which prevented their completion of client work.
Intellectual property
Client agrees that they own the rights to any information or content passed onto the designer. Designer therefore can assume any information passed onto them by the client, the client owns the rights to use +/or say. Designer will not be held responsible for any suits +/or cases resulting from misuse of information or imagery that client has not rightfully gained permission to use. Copyrights + IP (Intellectual Property) will belong to client only upon full payment of quoted incurred costs.
The designer will supply you with the print ready files of your completed artwork, + any links that may have been purchased etc along the way. In the event that the designer proposes to use any licensed content, the designer will quote content + outline license agreement for the client. In the event that the client wishes to proceed with the license, the license will be purchased either by the client, or by the designer on behalf of the client. Client will own the license + therefore accept responsibility in maintaining + adhering to license restrictions. By agreeing to these services you agree that designer retains the right to showcase + advertise your work with our website, but not limited to our portfolio. If there is any content that is sensitive + not suitable for this use, you will need to tell designer at the beginning of the project.
Pricing + payment terms
For new clients, a part payment of 30% of the total cost (as outlined in the quote) is required upfront, with the balance paid on completion. Any additional costs incurred throughout the job (outside of the initial scope detailed by the quote) are to be quoted as they arise + paid upon completion. Final invoice will be supplied on completion of the job with payment required within 14 working days of receipt. Any invoices that remain outstanding 60 days after the due date, may be passed to a collections agency chosen by Just Little Bird, for which the client will also be responsible for any collection (commission) fees incurred.
Additional work outside the scope of what is agreed before will be quoted by the designer + agreed to by the client before additional work commences. More than 3 rounds of changes to any supplied information or imagery will incur additional charges at either designer's hourly rate, or at an agreed rate between designer + client before changes are made. All prices quoted are true as at 1 April 2015 + remain subject to change at designer’s discretion. Prices do not include any third party service fees such as, but not limited to; printing, hosting, supplies, freight, e-commerce, e-marketing or media unless specifically stated in the quote.
We have a lot of time + respect for our clients + expect that in return. If you have trouble paying an invoice, a simple phone call or email can save a lot of time + hassle.
Privacy Policy
just Little Bird is dedicated to protecting client’s personal information.
This policy is provided for your information + does not limit or exclude your rights under the Privacy Act 1993.
Collecting information
We only collect information provided to us, by our client's in relation to delivery of purchased goods. This information includes your name, address, telephone number, purchase, purchase amount + purchase date + time. The information collected is for the purpose of processing your order, contacting you in relation to a purchase or query, for billing + for general administrative, business + tax requirements.
Sharing information
Your name + address may need to be shared with third parties in relation to the processing + delivery of your purchased items or to any person or authority as authorised by the Privacy Act 1993. If we do disclose information in relation to the processing or delivery of your order this will be limited to:

:: Protecting your personal information.
We will take all reasonable steps to ensure that the personal information we collect, use or disclose is accurate, complete, up-to-date + stored in a secure environment protected from unauthorised access, modification or disclosure. If needed, we may ask your permission to share your contact details with a thirds party, where it is imperative that the third party can contact you, in relation to the work undertaken between the designer + client. You have every right to agree or decline.
Accessing your personal information
You have the right to access your personal information, if we hold that personal information in a way that it can be readily retrieved. You may request access to personal information we hold about you be sending an email to hello@justlittlebird.co.nz
Internet use
We take reasonable steps to maintain the security of our Internet connections; however for reasons outside of our control, security risks may still arise. Any personal information transmitted to us or from our online products or services will therefore be at your own risk, however we will use our best efforts to ensure that any such information remains secure. We cannot protect any information that you make available to the general public. We may use cookies + other interactive techniques to collect non-personal information about how you interact with our website, + web-related products + services, to:
